从动员参与到合作治理:社会治理共同体的实现路径

社会治理共同体是新时期我国社会治理的重要主体,也是国家治理和基层治理现代化建设的重要研究对象。基于对S省Z市“民生微实事”项目的案例分析,提出“能力建设-惯习积累-信任强化”的分析框架,揭示了多元主体成长为社会治理共同体的机理,丰富了“主体关系”和“行动方式”的研究视角。研究发现,多元主体基于资源优势互补与主体责任再塑加强了能力建设,能力的提升使其有意愿并且能够建立合作关系;政府通过规则调适以及持续的参与激励来培养多元主体的合作惯习,有助于促进合作行动;共同议题下的利益相容和由参与效能感形成的良性循环会强化信任,进一步增强多元主体间的合作关系和合作行动,进而形成稳定、可持续的合作治理常态,使社会治理共同体得以实现。     

New Approaches to Age Estimation Using Palatal Suture Fusion

Palatal suture fusion has seen little testing and/or application due in part to an inadequately described relationship to formal age ranges. This study presents a modified scoring method that examines fusion on samples of modern documented adult males and compares two Bayesian approaches to age estimation. In the first analysis, American and Portuguese collections were used to derive univariate and multivariate transition analysis (TA) parameters, which combined with an informative prior, estimated age in a sample of modern Americans and Portuguese. For the second analysis, a Bayesian multiple linear regression (BMLR) used indicator statuses as the independent variables with age as the dependent variable. Highest posterior density regions (HPDRs) and highest posterior density intervals (HDI) were calculated for a holdout sample. Final age estimates for the methods were tested for accuracy using cumulative binomial tests at 75% and 90% coverages. The HPDRs from multivariate TA captured age better for younger individuals, but consistently underaged. The cumulative binomial tests on the BMLR results indicated the prediction intervals performed as expected, and we show they are narrower (more precise) and/or more accurate than the corresponding HPDR. The modified method presented here formally links palatal suture obliteration to age using two different approaches, one of which (BMLR) is new to the aging literature. The BMLR provided results free from bias and more reasonable age ranges while maintaining accuracy. We present a look-up table and a free, simple R file for users to download and run their own estimates with BMLR.     

我国社区治理“碎片化”整合机制探析

在我国社区治理不断深化的背景下,社区多元治理主体在参与治理过程中面临着"碎片化"困境,主要表现为治理主体的"碎片化"和治理过程的"碎片化"。治理主体"碎片化"分化为内部"碎片化"和外部"碎片化",治理过程"碎片化"表现为整体过程"碎片化"和具体过程"碎片化"。导致社区治理"碎片化"的根本原因在于多元治理主体的错位及协动不足。在未来的社区治理中,可以参考日本的社区协动治理机制,明确社区多元治理主体的角色定位,完善社区多元治理主体协动治理机制,以营造共建共治共享的良好氛围。     

“多次违法行为”入罪之思考——以多次非法行医为视角

我国法律规定未取得医生执业资格的人非法行医,被卫生行政部门行政处罚两次以后,再次非法行医的,应当以非法行医罪追究其刑事责任。此种将多次行政处罚后再实施违法的行为纳入刑事犯罪构成要件或者说作为罪量要素的定罪模式是合理的,不违反禁止重复评价原则和刑法谦抑性原则。但为了防止刑事制裁范围的肆意扩大,应从违法主体、违法程序及违法次数上对"非法行医被二次行政处罚后再次非法行医"入罪进行一定的限制,以实现人权保障和惩罚犯罪的有机统一。     

主体建构理论及其一般机制——基于“提供性服务歌厅”老板言及“小姐”时自我呈现的社区考察

基于对提供性服务歌厅的相处式社区考察,文章从主体和情境视角分析了歌厅老板对"小姐"的建构与言说及其不一致的现象,通过解读老板在言及他人时进行信息控制的感性意识和理性选择,阐述了主体建构的理论要点和一般机制:(1)主体建构是内化了社会建构的再建构;(2)当社会建构呈贬抑时,主体建构对内呈顺向弱化或逆向否定建构,对外呈顺向强化建构;(3)当社会建构呈褒扬时,主体建构对内呈顺向强化建构,对外呈顺向弱化或逆向否定建构;(4)主体建构与言说的不一致,是主体在情境中的自我呈现策略。     

The Shield of Heracles: Multiple streams and the emotional endowment effect

What factors explain the persistence of emotion in public policy? Applying the multiple streams framework, it is hypothesised in this article that the more intense the fear and the longer it persists under high salience, task unfamiliarity and complexity, and inconsistent preferences, the less likely it is for policy to change. The study examines the Greek attempt to block international recognition of the Former Yugoslav Republic of Macedonia (1990–1993) and finds the power to build coalitions through emotional arousal that in the short run helps reframe losses and paradoxically undermines political support in the long run. Illuminating the emotional endowment effect within the logic of appropriateness, the article concludes that policy is made under certain conditions on the basis of validating emotions.     

毒品公开查缉的程序应用及评测

毒品公开查缉是指执法部门根据查缉毒品的需要,依法采取的以公开方式在边境地区、交通要道、口岸、山间通道、收费站以及飞机场、火车站、长途汽车站、码头、货运物流场所对来往人员、物品、货物、交通工具进行检查、盘查以及现场处置等措施,以期查获毒品、易制毒化学品、毒品原植物、种子及其幼苗的一项专门工作。公开查缉的基本任务是预防、发现、打击毒品违法犯罪活动,将走私渗透入境的毒品堵截查获在辖区内,努力减少毒品内流造成更大的社会危害。同时开展双向查缉,堵截易制毒化学品非法走私外流出境。     

萨特主体间性理论的美学出路

萨特在其<存在与虚无>中提出了主体间性理论,依此,人与人之间的原始冲突是不可克服的;但其美学论文则讨论了人类文学活动中作家-作品-读者三者之间关系,在文学活动中,这种特殊主体间性关系,作者和读者相互之间体现为超越性的关系,而不是对象化的原始冲突关系,文学阅读(审美)对于人与人共同生存就具有了超越性和现实性的意义.萨特的主体间性理论虽在哲学中陷入矛盾,但在美学中又可别开生面.     

Bringing the battlefield into the classroom: using video games to teach and assess international humanitarian law

The graphic and widespread atrocities committed during conflicts around the world and broadcast across 24/7 news and social media have made war never feel so close and the powerlessness of law seem so real. This raises difficulties in engaging students in real-life decision-making quandaries where military necessity meets legalism, as well as fundamental ethical questions about the use of realistic, yet explicit, imagery in the classroom. The School of Law at Queen’s University Belfast has developed a series of innovative computer scenarios based on the Arma 3 open world tactical war simulator. A variety of formative scenarios (addressing issues such as cluster munitions and landmines) were developed to familiarise the students with the factual scenario and the computer technology. Subsequently, students engaged in a summative assessment to test their legal understanding in the face of increasingly challenging conflict situations, in particular grey zones where legal argument can justify seemingly morally wrongful acts during war. This paper examines both the learning objectives of this project, and the project development cycle – from the initial proposal to its implementation in class, as well as positing the benefits and drawbacks in integrating technology and games into the legal teaching environment, reflecting on the emerging and traditional pedagogy in this area.
